Terms of Service
Effective date: August 3, 2026 · Last updated: September 29, 2026
These Terms of Service ("Terms") govern use of the CallSharp service, operated by SHARP AI ("we," "us," "our"). By using the Service — as a Contractor subscriber or as a Customer/Caller interacting with a Contractor's CallSharp-powered number — you agree to these Terms.
1. Service Description
CallSharp provides an AI-powered virtual receptionist service for home service contractor businesses (HVAC, plumbing, electrical, roofing, and similar trades). When a Contractor is unavailable, calls to their business may be forwarded to a number operated by CallSharp, where an AI assistant answers, qualifies the request, checks availability, and books appointments on the Contractor's behalf. Customers may also text this number directly.
You are interacting with an AI system. Calls and texts handled through CallSharp are answered by an automated AI assistant, not a live human employee of the Contractor, unless and until a call is transferred to the Contractor directly.
2. Eligibility
The Service is intended for use by businesses and their customers in connection with legitimate service requests. You must be at least 18 years old to use the Service.
3. Contractor Accounts
Contractors who sign up for CallSharp are responsible for:
- Providing accurate business information used to configure their AI assistant
- Maintaining the security of their account credentials
- Ensuring they have the right to forward their business calls to the number we provide
- Complying with applicable law in how they use the Service, including telemarketing and consumer-protection laws relevant to their business
4. Call Recording
Calls handled through the Service may be recorded for quality assurance, transcription, and record-keeping purposes. Where required, a recorded disclosure is played informing callers that the call may be recorded.
5. SMS Terms
Text messages are optional. Agreeing to receive them is never a condition of using the Service, creating an account, or booking an appointment. Consent to texts is collected separately from these Terms, as described on our SMS consent page.
- Contractors receive SMS alerts (new leads, bookings, voicemails, account updates) only if they opt in, using a separate unchecked checkbox at signup or the Text alerts setting in the dashboard. Without it, lead, booking, voicemail and account alerts are sent by email.
- Customers receive a booking confirmation and appointment reminders by text only if they say yes when the assistant asks. Customers who text a Contractor's CallSharp number receive replies to their own messages about their request. A customer who calls while the Contractor's line is at capacity is told on the call that they may receive one text inviting them to book by replying.
- Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. Carriers are not liable for delayed or undelivered messages.
- Mobile numbers and SMS opt-in consent are never shared with or sold to third parties for marketing. See our Privacy Policy for how message data is used and retained.
6. Subscription Plans and Billing (Contractors)
Contractor subscriptions are billed according to the plan selected at signup, via Stripe. Each plan includes a monthly allowance of voice minutes and text messages sent on your behalf; incoming texts from your customers do not count against that allowance. Once an allowance is used up, the Service continues to capture leads for you through its fallback handling, but AI voice or text handling may be limited until your allowance resets. Details on current plans and pricing are available on our pricing page.
7. Acceptable Use
You may not use the Service to:
- Send unlawful, harassing, fraudulent, or deceptive communications
- Violate any applicable telemarketing, robocall, or messaging consent law
- Attempt to disrupt, reverse-engineer, or abuse the Service's infrastructure
8. Disclaimer of Warranties
The Service is provided "as is." While we design the Service with reliability safeguards (including fallback handling when the AI or booking system is unavailable), we do not guarantee that the Service will be uninterrupted, error-free, or that every call or message will be handled exactly as a human receptionist would.
9. Limitation of Liability
To the maximum extent permitted by law, SHARP AI's liability for any claim arising from use of the Service is limited to the amount paid by the Contractor for the Service in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost business or missed appointments.
10. Termination
We may suspend or terminate access to the Service for violation of these Terms. Contractors may cancel their subscription at any time; see our Privacy Policy for what happens to data after cancellation.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
